1. Acceptance of Terms

By accessing or using the ZazaVoice platform at zazavoice.com (the "Service"), you agree to be bound by these Terms of Service. The Service is provided by MR Recruits Limited Liability Company ("MR Recruits LLC", "we", "us", or "our"), a company organized under the laws of the United States.

ZaZaVoice is a product of MR Recruits Limited Liability Company (USA).

2. Description of Service

ZazaVoice is a SaaS platform that allows businesses to create AI-powered voice agents, purchase phone numbers, and automate phone calls. We operate as an Independent Software Vendor (ISV) and authorized reseller. We do not own or operate telecommunications networks. Voice and telephony services are provided through Twilio, a third-party cloud communications provider.

We are not a telecommunications carrier. We do not make any representations about owning network infrastructure. All telephony capabilities are facilitated through our integration with Twilio's platform.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old and have the legal authority to enter into these terms on behalf of yourself or your organization.

4. User Responsibilities and Compliance

You agree to use the Service in compliance with all applicable laws and regulations. Specifically, you are responsible for:

• Consent and Opt-In: Obtaining all necessary consents from individuals before placing calls or sending messages through the Service. This includes obtaining prior express written consent where required by law.
• TCPA Compliance: Complying with the Telephone Consumer Protection Act (TCPA) and all related FCC regulations, including maintaining do-not-call lists and honoring opt-out requests.
• Local Telecom Regulations: Complying with all applicable federal, state, and local telecommunications regulations in any jurisdiction where calls are placed or received.
• Lawful Use: Using the Service only for lawful business purposes. You must not use the Service for harassment, fraud, spam, or any unlawful purpose.
• Recording Consent: Where call recording is enabled, ensuring compliance with all applicable recording consent laws (one-party or two-party consent states).

5. Prohibited Uses

You must not use the Service to:

• Make robocalls without proper consent
• Engage in telemarketing fraud or deceptive practices
• Violate any do-not-call registry requirements
• Impersonate individuals or organizations
• Transmit threats, harassment, or abusive content
• Interfere with or disrupt the Service or other users
• Attempt to gain unauthorized access to the Service or related systems

6. Billing and Payment

Paid features are billed on a subscription basis. Payments are processed through Stripe. You agree to provide accurate billing information and authorize recurring charges as described in your selected plan. Subscription fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

7. Intellectual Property

The Service, including its design, code, features, and content, is owned by MR Recruits LLC and protected by intellectual property laws. You retain ownership of your data and content uploaded to the Service.

8. Limitation of Liability

To the maximum extent permitted by law, MR Recruits LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free operation of the Service.

10. Termination

We may suspend or terminate your account if you violate these Terms or use the Service in a manner that could harm us or other users. You may cancel your account at any time through the dashboard or by contacting us. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law provisions.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page. Continued use of the Service after changes constitutes acceptance of the new terms.
